Many times, landowners with oil and gas leases do not realize that there are contingencies in the leases that keep them in force and effect. The primary contingency is that the lease only stays in effect as long as the lessee produces oil or gas in paying quantities. If the company does not produce oil or gas in paying quantities and pay the landowner, it is required to pay “shut-in” royalties to keep the lease in effect.
If the company fails to produce and fails to pay shut-in royalties, the lease may terminate. My law firm handles lease and royalty disputes that hinge upon whether or not the original lease has terminated, giving the oil or gas production rights back to the landowner.
